Terms of Use — 137 Publisher

These Terms of Use govern your use of 137 Publisher, developed and operated under the 137 Solutions brand, and the features available through the application.

1. About the Service

137 Publisher provides tools to create, organize, edit, and publish content to platforms connected by the user.

Available features depend on the application version, the subscription plan, if any, and the availability and authorization of integrations with external services. Features under development or testing may not be available to all users.

2. Accounts and Access

You must provide accurate information, protect access to your account, and connect only accounts and channels that you own or are authorized to manage.

Your use of the application must comply with applicable age and legal capacity requirements, as well as the rules of connected platforms.

If you become aware of unauthorized access, contact support using the contact information at the end of these Terms.

3. Connected Platforms

Some features require you to connect accounts from external services and grant the necessary permissions.

These permissions allow the application to perform actions you request, within the available features and permissions granted. Connecting an account does not grant unrestricted permission to publish content.

You may revoke access through controls provided by the connected platform or by 137 Publisher, where available. Revoking access may prevent publishing and other operations that depend on that connection.

137 Publisher is an independent service. An integration does not imply that the connected platform sponsors, endorses, or is responsible for the application.

4. Content Review and Publishing

Before requesting publication, you should review the content, destination account, media, text, and available visibility settings.

Each platform has its own formats, limits, and rules. Content may require adjustments for each destination, and the receiving platform may reject, delay, or restrict a publication.

When publishing to multiple channels, success on one platform does not guarantee success on the others. Check the results before repeating an operation to avoid duplicate publications.

5. Artificial Intelligence Features

Where available, artificial intelligence features may assist with creating, reviewing, and adapting text or images.

Results may contain errors, outdated information, or elements similar to third-party materials. You should review their accuracy and suitability before using or publishing them.

These features do not guarantee originality, exclusivity, audience reach, sales, or any particular outcome.

Information processed through these features is subject to the application’s Privacy Policy.

6. Content and Intellectual Property

You retain any rights you hold in the materials you upload or create. Using the application does not transfer ownership of those materials to 137 Publisher.

When you request an operation, you authorize the processing, technical reproduction, format adaptation, and transmission of your content to the extent necessary to carry out that operation and provide the service.

You must hold the necessary rights or permissions for any text, images, videos, music, trademarks, or third-party data you use, including permission to use a person’s likeness where required.

This authorization does not permit 137 Publisher to sell your content or use it in its own advertising without separate authorization.

7. Prohibited Uses

You must not use the application to:

  • Publish unlawful content or violate third-party rights.
  • Engage in fraud, impersonation, harassment, threats, or exploitation.
  • Distribute malicious software, access accounts without authorization, or compromise system security.
  • Send spam or publish content that violates the destination platform’s rules.
  • Circumvent access restrictions, technical limits, or security measures.
  • Disclose third-party personal data without an applicable lawful basis or authorization.

8. Availability and External Services

Some features depend on an internet connection and external services.

Changes to third-party APIs, permissions, policies, limits, or availability may affect integrations. 137 Publisher may adapt or discontinue affected features and will inform users where appropriate.

The application may require maintenance or experience failures. You should retain copies of important materials and check that publishing operations have completed.

These conditions do not remove the service provider’s legal obligations or your statutory consumer rights.

9. Plans and Payments

If paid features are offered, prices, features, limits, renewal conditions, and cancellation methods will be disclosed before purchase.

Reading these Terms does not create a payment obligation. A purchase requires your agreement to the offer presented.

Cancellations, refunds, and any applicable statutory withdrawal rights will be governed by applicable law and the conditions disclosed at purchase, without limiting mandatory rights.

10. Privacy and Account Deletion

Deleting your 137 Publisher account does not automatically delete content or accounts maintained on external platforms. You must manage those materials directly through the respective services.

Information may be retained where there is a lawful basis for doing so, as described in the Privacy Policy and applicable law.

11. Suspension and Termination

Access may be restricted when there are reasonable grounds to suspect fraud, unlawful use, security risks, or violations of these Terms.

Measures should be proportionate to the circumstances. Where feasible and appropriate, you will be informed of the reason and may request clarification or review through support. Immediate security risks or legal requirements may require action without prior notice.

You may stop using the service and request account deletion. Any subscription must be canceled through the relevant purchase channel.

12. Responsibilities

Each party is responsible for its actions and obligations under applicable law.

You are responsible for the content and actions you authorize, without prejudice to the service provider’s legal responsibilities.

Nothing in these Terms excludes liability that cannot legally be excluded, limits mandatory consumer rights, or prevents the exercise of personal data rights.

13. Changes to These Terms

These Terms may be updated to reflect changes to the service or legal requirements.

The current version will be published on this page with an updated date. Material changes will be communicated appropriately, and renewed agreement will be requested where required.

Changes will not remove acquired rights or retroactively alter conditions to your detriment in a manner contrary to applicable law.

14. Applicable Law

These Terms are governed by Brazilian law, without prejudice to other mandatory laws applicable to your relationship with the service.

Disputes may be referred to consumer protection authorities or the competent courts, preserving any right to a particular court or jurisdiction granted to consumers by applicable law.
